Terms of Service

These Terms govern your use of ACondor, the automated options trading software operated by ACondor LLC (“ACondor,” “we,” “us”). By creating an account, subscribing, or using the software, you agree to them. If you do not agree, do not use ACondor.

1. What ACondor is

ACondor is software that executes a defined options premium selling strategy against brokerage accounts you connect. It is a tool that carries out rules you configure and enable. It is not a managed account, not a fund, not a signal service, and not a discretionary advisory relationship. We never take custody of your money or your securities. Your assets stay in your brokerage account at all times.

2. We are not an adviser or a broker

ACondor LLC is not a registered investment adviser, broker-dealer, commodity trading advisor, commodity pool operator, or financial planner, and is not registered with the SEC, FINRA, the CFTC, the NFA, or any state securities regulator. Nothing produced by ACondor or published on this site is investment, legal, accounting, or tax advice, and nothing is a recommendation to buy or sell any security. We do not know your financial situation, risk tolerance, or objectives, and nothing we provide is personalized to them.

All content is impersonal and of general circulation, provided for informational and analytical purposes to a general audience.

3. Eligibility

You must be at least 18 years old, legally able to enter contracts, and permitted to trade options in your jurisdiction. You must hold your own brokerage account, approved by your broker for the option strategies you enable. ACondor is intended for people with prior options trading experience. It is not a product for learning options.

4. Your account and your responsibilities

You are responsible for:

  • Reviewing and understanding every strategy, risk parameter, and account setting before enabling it. Defaults are starting points, not recommendations for your situation.
  • Starting and stopping the bot. It trades only while you have it running.
  • Monitoring your account, positions, and orders on an ongoing basis, and independently verifying fills and positions with your broker.
  • Keeping your credentials secure, and revoking your broker OAuth application if you suspect compromise.
  • All tax reporting and all consequences of trades placed in your account.

Every trade placed through your account is your trade, whether you selected it manually or the software selected it under rules you enabled.

5. Acknowledgment of risk

Options trading involves substantial risk of loss and is not suitable for every investor. You can lose more than you deposit. Certain strategies carry undefined risk. Assignment, early exercise, gaps, halts, illiquidity, and limit moves can produce losses far larger than anticipated. You may lose your entire account.

Automated trading adds its own risks: software defects, misconfiguration, downtime, connectivity loss, latency, broker API failures, duplicate orders, missed orders, and orders placed on stale data. The bot can act, or fail to act, at the worst possible moment.

6. Subscription and billing

ACondor is sold as a recurring subscription, billed in advance through Stripe. By subscribing you authorize recurring charges to your payment method until you cancel. Prices may change with at least 30 days notice before the change takes effect for you.

You may cancel at any time. Cancellation stops future billing and your access continues through the end of the period you already paid for. Refunds are governed by our Refund Policy.

If payment fails or a subscription lapses, we may suspend or stop your bot instance. A stopped bot does not place new trades and does not manage existing positions. Positions open at that time remain your responsibility to manage directly with your broker.

7. Acceptable use

You may not:

  • Resell, sublicense, redistribute, or operate ACondor on behalf of third parties, or use it to manage money that is not yours, without our written agreement.
  • Reverse engineer, decompile, or attempt to extract the strategy logic or source code.
  • Use ACondor for market manipulation, or in any way that violates securities law, exchange rules, or your broker's terms.
  • Attempt to access another customer's instance or data, or probe, scan, or test our infrastructure outside the disclosure process on our Security page.
  • Share your account credentials or your subscription with others.

8. Support boundaries

Support covers installation, configuration, and defects in the software. Support does not include trade advice, opinions on whether to take a position, tax guidance, or predictions about markets. We will not tell you what to trade or what settings are right for your financial situation, because doing so would be personalized advice we are not registered to give.

We will never ask for your brokerage password or a two-factor code. Wherever possible, troubleshooting is done against sandbox or paper configurations rather than live accounts.

9. Third-party services

ACondor depends on services we do not control, including tastytrade, Anthropic, market data providers, news providers, and cloud infrastructure. Your relationship with your broker is directly with your broker and governed by its agreements, not ours. We are not responsible for outages, errors, data quality, pricing, rejections, or changes in those services, or for any losses that result from them.

ACondor is not affiliated with, endorsed by, or sponsored by tastytrade or Anthropic.

10. Intellectual property

ACondor, its software, documentation, and site content are owned by ACondor LLC. Your subscription grants you a limited, non-exclusive, non-transferable, revocable right to use the software for your own accounts while your subscription is active. It does not transfer ownership of anything.

Your data, your configuration, and your trading history are yours. We claim no ownership of them and do not publish them.

11. No warranty

The software is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the software will be uninterrupted, error free, available at any particular time, or that it will produce any particular result. No representation is made that any account will or is likely to achieve profits or losses similar to any figure shown anywhere.

12. Limitation of liability

To the maximum extent permitted by law, ACondor LLC and its owner, officers, and agents are not liable for any trading losses, lost profits, missed trades, erroneous or duplicate trades, assignment costs, margin calls, tax consequences, data loss, or any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of ACondor, whether caused by software defects, downtime, misconfiguration, market conditions, broker or third-party failures, or any other cause.

Our total aggregate liability for any claim relating to ACondor is limited to the subscription fees you actually paid us in the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless ACondor LLC from claims, losses, and expenses, including reasonable legal fees, arising from your use of ACondor, your trading activity, your breach of these Terms, or your violation of any law or third-party right.

14. Suspension and termination

You may stop using ACondor and cancel at any time. We may suspend or terminate your access for non-payment, breach of these Terms, or conduct that creates legal or security risk. We may also discontinue the product entirely, in which case we will give reasonable notice and refund any prepaid period you have not used.

On termination, revoke your broker OAuth application and take direct control of any open positions. Positions do not close themselves when a subscription ends.

15. Changes to these Terms

We may update these Terms. If a change is material, we will notify subscribers by email or by prominent notice before it takes effect. Continuing to use ACondor after that means you accept the updated Terms. The “last updated” date above always reflects the current version.

16. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in New Mexico, and both parties consent to that jurisdiction.

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
